Description

The purpose of this course is to give the student an introduction to the Irish and European legal systems. The student will be introduced to the basic principles in law, which are essential in the commercial environment. It is intended that this module will create an awareness of where legal expertise may need to be sought.

This module build on the knowledge acquired in Foundations of Business Law.

Learning Outcomes

On completion of this module the learner will/should be able to;

1.

Outline the legislation in relation to consumer law;

2.

Outline the legislation in relation to a variety of business activities such as marketing, franchising, agency, insurance;

3.

Apply the fundamental principles of employment law and equality law to facilitate informed decisions in the commercial environment;

4.

Recognise key factors which will influence decision making within a complex legal environment;

5.

Demonstrate the ability to cooperate and work effectively with peers.

Teaching and Learning Strategies

This module will be delivered by lecture and tutorial support as appropriate. The learner will be supported in developing an understanding of the theory and key principles in this area and how these apply in the commercial environment. Reference will be made to case study material to support this objective.

Module Assessment Strategies

This module will be assessed by Continuous Assessment (20%) during the semester and by an end of semester 2 hour written exam (80%).

Repeat Assessments

Repeat assessments will be developed as appropriate to assess failed elements.

Indicative Syllabus

1.        Commercial Law 

  • Demonstrate an understanding of agency,franchising and distribution;
  • Describe the fundamental principles of insurance;
  • Money laundering and credit cards.

 

2.         Legal issues in relation to Marketing

  • Outline the main provisions of Irish and European consumer law;
  • Identify the role of the Competition and Consumer Protection Commission for the individual and for businesses;
  • Data protection and privacy;
  • Website legal issues.

3.         Employment Law

  • The essential elements of an employment contract;
  • The obligations and duties of employers and employees;
  • Termination of a contract of employment - Unfair Dismissals legislation;
  • Equality legislation;
  • Health and Safety legislation.

4.        Introduction to Intellectual Property

  • Trademarks, Copyright, Patents and Design;
  • Commercial Dispute Resolution.

5.      Introduction to International Trade Law 

  • Sources of International Trade Law;
  • International sales contracts.
