LAW06023 2022 Law for Business
The purpose of this course is to give the student an introduction to the Irish and European legal systems. The student will be introduced to the basic principles in law, which are essential in the commercial environment. It is intended that this module will create an awareness of where legal expertise may need to be sought.
Learning Outcomes
On completion of this module the learner will/should be able to;
Describe the system of administration of justice in Ireland;
Distinguish between Irish and European laws and assess their impact on Irish business activities;
Apply the fundamental principles of contract law and tort law to facilitate informed decisions in the commercial environment;
Recognise key factors which will influence decision making within a complex legal environment;
Demonstrate the ability to cooperate and work effectively with peers.
Teaching and Learning Strategies
Lectures will occur online using synchronous and asynchronous learning. Student engagement is encouraged, with opportunities to explore practical examples.
Module Assessment Strategies
This module will be assessed by both continuous assessment and final examination.
Repeat Assessments
Repeat assessment requirements will be identified by the relevant lecturer in conjunction with the examinations board.
Indicative Syllabus
1. Introduction to the Irish and European legal systems:
- Sources of law, the Irish Constitution, Separation of Powers;
- Personnel of the law and the Irish court system;
- The importance of European Union law in relation to our legal system.
2. The fundamental principles of contract law:
- The essential elements of a legally binding contract;
- Differentiate between the various terms of a contract;
- Exemption clauses and contracts in restraint of trade;
- Termination of contracts and remedies for breach of contract;
- Electronic contracts.
3. The fundamental principles of tort law:
- Describe the basic principles of the law of negligence;
- Product liability and employer's liability.
4. Commercial Law:
- Outline the main provisions of consumer protection law;
- Demonstrate an understanding of agency, franchising and hire purchase agreements;
- Describe the fundamental principles of insurance, and the insurance contract;
- Credit security, banking and finance.
5. Employment Law:
- The essential elements of an employment contract;
- The obligations and duties of employers and employees;
- Termination of a contract of employment - Unfair Dismissals legislation;
- Equality legislation.
