Description

The aim of this module is to enable the student to acquire a thorough understanding of contract administration and to develop the student's competence in the application of general legal principles and specific contractual procedures in the management of construction projects. The module will examine the legalities of contract formation and the various forms of standard construction contracts. Learners will explore and develop an an understanding of the various procurement routes that are available in the construction industry.

Learning Outcomes

On completion of this module the learner will/should be able to;

1.

Apply the documentation relating to construction contracts from inception to completion of the project.

2.

Compare and contrast procurement routes, then formulate advice on the most suitable procurement route and contractual strategy to use on a particular construction project.

3.

Demonstrate an understanding of the administration process of construction contracts from commencement to completion.

4.

Identify, examine and then define the legalities of contract formation and the various forms of standard construction contracts.

5.

Formulate advice with respect to cost and financial administration of the project.

Teaching and Learning Strategies

This module will be delivered using blended learning techniques.

This will include online lectures (via adobe connect or similar), workshops and work based learning where relevant along with guest lectures and augmented by independent learning and directed learning.

This approach is expected to address student learning needs.

Moodle will be used to upload educational material (i.e. presentations and recordings of online lectures plus supplementary reading material and additional resources).

Moodle will also be further used as a means of assessment, utilising online quizzes, for the uploading of assignments and reports.

This multi-faceted, blended approach of; lectures, workshops and online resources fosters collaborative student learning.

Module Assessment Strategies

Module will be assessed using a combination of end of semester final exam (60%), continuous assessment and course work (40%). The continuous assessment and course work will involve one assignment where students will be required to;

Examine the various Procurement Routes available and then suggest and justify recommendations for a basic procurement route approach for the
successful delivery of suggested construction projects

Repeat Assessments

Repeat Continuous Assessment and/or Final Exam.

Contractor's financial management during progress of the works, cash flows, cost-value reconciliation and payment methods.

Ethics within the construction industry.

Introduction to the law of contract.

Performance bonds.

Principles of insurance.

Procurement methods and contractual types and arrangements.

Standard forms of contract - incorporating: project control procedures including interim valuations and final accounts, variations/change orders, nominated subcontractors and suppliers, delay and disruption, extensions of time, fluctuations in price, determination / termination.
